Terms of Service

Welcome to TALKme (https://talkme.online). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and TALKme ("we", "us", "our"), governing your access to and use of the TALKme web application, Android mobile app, voice rooms, text chat, games, and related services.

1. Acceptance of Terms

By creating an account, browsing the website, joining a room, downloading the Android APK, or otherwise accessing TALKme, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the service.

2. Eligibility & Account Registration

• Age Requirement: You must be at least 13 years of age (or the minimum legal age required in your country of residence) to register an account or use TALKme. By using the service, you represent and warrant that you meet this requirement.
• Account Accuracy: You agree to provide a valid email address during registration and maintain accurate account details. Impersonation of any person or entity is strictly prohibited.
• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

3. Community Standards & Prohibited Conduct

TALKme was built to provide a peaceful, respectful, and harassment-free environment. You agree that you will NOT use TALKme to:

• Harass, stalk, intimidate, bully, threaten, or defame any individual or group.
• Publish, transmit, or promote hate speech, discrimination, harassment, or unlawful violence.
• Upload, share, or transmit Child Sexual Abuse Material (CSAM) or any exploitative content involving minors (which will result in immediate termination and referral to law enforcement).
• Send unsolicited commercial communications, chain letters, pyramid schemes, or bulk spam.
• Probe, scan, reverse-engineer, or attempt to breach TALKme's server infrastructure, encryption keys, or WebSocket endpoints.
• Deploy unauthorized automated bots, scrapers, or scripts without express written permission from TALKme administrators.
• Circumvent or interfere with the YouTube API Services integration, including extracting, downloading, sublicensing, or distributing YouTube audio or video streams in violation of YouTube's Terms of Service.

4. Real-Time Voice and Video Calling

TALKme enables peer-to-peer and relayed voice and video calling powered by WebRTC technology:

• Mutual Consent: Voice and video calls can only be initiated between mutual friends or with explicit recipient acceptance.
• Zero Server Recording: Audio and video streams are transmitted directly in real time and are never recorded, monitored, or saved by TALKme.
• Local Recording Prohibition: You agree not to record, capture, or rebroadcast voice or video calls without the clear, express, and legally required consent of all participants.

5. User Generated Content & 24-Hour Stories

You retain full ownership of all text messages, display names, profile avatars, and media files you submit to TALKme:

• License to Operate: By submitting content, you grant TALKme a worldwide, royalty-free, non-exclusive license solely to transmit, process, cache, and display your content to your designated recipients to operate the service.
• 24-Hour Stories Lifecycle: Content published to your Story is stored temporarily on Cloudflare R2 edge storage and is automatically and permanently purged after 24 hours.
• Content Responsibility: You are solely responsible for the content you transmit. TALKme does not endorse and is not responsible for user-generated content.
• Moderation: Designated administrators reserve the right to review reported content, remove material that violates these Terms, and suspend offending accounts.

6. Intellectual Property & Third-Party Services

• TALKme Property: All software, trademarks, logos, UI designs, code, and graphical assets of TALKme are owned by or licensed to TALKme and are protected by applicable intellectual property laws.
• YouTube & Google Property: All YouTube videos, channel names, music, album artwork, and trademarks displayed via the YouTube API Services are the property of Google LLC, YouTube LLC, or their respective copyright holders. Nothing in these Terms grants you any ownership rights in YouTube content.
• Third-Party Integrations: TALKme relies on third-party services including Google Firebase, Cloudflare, and WebRTC protocols. Your use of these services through TALKme is subject to their respective terms and policies.

7. Streaks, Badges & Gamification

TALKme includes motivational gamification features such as daily login streaks, streak recovery shields, trivia reward points, and VIP profile badges:

• All streaks, badges, points, and virtual ranks are purely promotional and social features provided for entertainment purposes.
• They have no cash value, cannot be redeemed for real currency, and may be reset or modified at any time by the operator without liability.

8. Account Termination & Deletion

• Voluntary Deletion: You can permanently delete your account at any time through the in-app profile menu or via the Account Deletion Page. Deletion immediately wipes your login credentials, active sessions, and direct message history.
• Termination by TALKme: We reserve the right to suspend or permanently terminate your account without prior notice if you violate these Terms, engage in unlawful conduct, or compromise community safety.

9. Disclaimer of Warranties

TALKme is provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that calls, messaging, or YouTube audio streams will be continuous, error-free, or compatible with every browser or device.

10. Limitation of Liability

To the fullest extent permitted by applicable law, TALKme, its owners, operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, profits, reputation, or service interruptions, arising out of or related to your access to, use of, or inability to use TALKme or any third-party services (including YouTube API Services).

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal disputes or claims arising out of or related to these Terms shall be resolved through good-faith negotiation, or submitted to competent courts of appropriate jurisdiction.
